Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Drifty Technologies Private Limited ("Drifty", "Company", "we", "us"), governing your access to and use of the Drifty mobile application, website at drifty.app, and all associated services (collectively, the "Platform").

By creating an account, downloading the application, or accessing any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

Eligibility

To use Drifty, you must meet ALL of the following eligibility criteria:

• You are at least 18 years of age.
• You are a resident of India or accessing the Platform from India.
• You are legally capable of entering into a binding contract under the Indian Contract Act, 1872.
• You have not been previously banned or removed from Drifty for violations of these Terms.
• You are using the Platform for genuine personal social and romantic purposes, not commercial solicitation.

Account Registration & Security

Creating Your Account

You must register using your real identity. You may not create accounts using another person's information, fictional identities, or automated means. Each person may maintain only one active account at a time.

During registration, you must complete our Aadhaar-linked selfie verification. This process is mandatory and cannot be bypassed.

Account Security

• You are solely responsible for maintaining the confidentiality of your account credentials.
• You must immediately notify us at driftysupportapp@gmail.com if you suspect any unauthorized access.
• Drifty will never ask for your password via email, SMS, or chat.

User Conduct & Community Standards

Drifty is a respectful, inclusive community. By using the Platform, you agree to treat every member with dignity and respect.

You Agree To:

• Represent yourself honestly and authentically in your profile and communications.
• Respect boundaries — if someone says no or stops responding, stop contacting them.
• Report any suspicious or abusive behavior via the in-app report function.
• Maintain respectful communication, even when interactions don't lead to a match.
• Use the Platform solely for its intended purpose of personal dating and social connection.
• Comply with all applicable Indian laws in your use of the Platform.

Prohibited Activities

The following activities are strictly prohibited on Drifty and will result in immediate account suspension or permanent termination:

Content & Intellectual Property

Your Content

You retain ownership of all content you create and upload to Drifty. By submitting User Content, you grant Drifty a worldwide, non-exclusive, royalty-free licence to use, store, display, and distribute your content solely for the purpose of operating and improving the Platform.

Content Standards

All User Content must comply with our Community Guidelines. You may not upload nudity or sexually explicit content, images of minors, content depicting violence or self-harm, or copyrighted material you don't own.

Drifty's Intellectual Property

All Platform content not created by users — including the Drifty name, logo, application design, matching algorithms, and vibe scoring technology — is the exclusive intellectual property of Drifty Technologies Private Limited, protected under Indian copyright, trademark, and patent law.

Premium Services & Payments

Payment Terms

• All payments are processed in Indian Rupees (INR) via our authorized payment partners.
• By subscribing, you authorize us to charge your selected payment method on a recurring basis.
• Prices displayed are inclusive of applicable GST.

Cancellation & Refunds

• You may cancel your Premium subscription at any time through the app or your device's subscription settings.
• Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for unused time.
• Purchases made through the Apple App Store or Google Play Store are subject to those platforms' respective refund policies.

Privacy

Your privacy is fundamental to everything we do. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

• We will never sell your personal data to third parties.
• Your data is stored in India on encrypted servers.
• You own your data and can request deletion at any time.
• We comply fully with the Digital Personal Data Protection (DPDP) Act, 2023.

Disclaimers & No Guarantees

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

• The accuracy, completeness, or truthfulness of any user's profile information.
• The behaviour of other users on or off the Platform.
• Uninterrupted, error-free, or secure access to the Platform at all times.

Limitation of Liability

To the maximum extent permitted by applicable Indian law, Drifty Technologies Private Limited and its directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total aggregate liability to you for any claim arising from use of the Platform shall not exceed the total amount you paid to Drifty in the 3 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Drifty Technologies Private Limited and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, penalties, costs, and expenses (including reasonable legal fees) arising from or relating to your use of the Platform, your violation of any part of these Terms, or your User Content.

Suspension & Termination

Termination by You

You may terminate your account at any time. See our Account Deletion page for instructions. Upon deletion, your profile will be removed from other users' view within 24 hours, and your personal data will be deleted within 30 days.

Termination by Drifty

We may suspend or permanently terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or abusive behavior, or provided false information during registration.

Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

Jurisdiction

The courts of Bangalore, Karnataka, India shall have exclusive jurisdiction over any disputes arising from these Terms.
